Justice Jaiteh Overturns the Kombo South Tribunal’s Decision

Gambia-High-Court-Land-Dispute

The High Court, led by Justice Ebrima Jaiteh, overturned a ruling from the Kombo South District Tribunal in a land dispute case between Inna Puye and Koko Williams.

Inna Puye appealed the Tribunal’s decision, which claimed that land transactions require approval from the local Alkalo. The High Court found that the Tribunal had exceeded its authority and had not properly handled the burden of proof.

Koko Williams failed to provide sufficient evidence for his claim, while Inna Puye presented credible evidence demonstrating her rightful ownership since 2001.

The court criticized the Tribunal for relying on unverified historical accounts and concluded that Inna Puye’s continuous use of the land was not adequately considered.

The High Court granted Inna Puye’s appeal, dismissed Koko Williams’s claim, ordered him to pay D50,000 in costs, and allowed Inna Puye to continue occupying the land peacefully.
