Justice Ebrima Jaiteh of the High Court in Banjul has sent the Bankai/Gamtel case to the International Court of Arbitration in London.
Bankai International Private Limited is seeking USD 2,940,012.01 for international telephone services rendered to Gamtel.
Justice Jaiteh highlighted discrepancies in the plaintiff’s assertions, which weakened their credibility.
Gamtel, through attorney AA Bensouda, refuted any acknowledgment of debt and established a task force to investigate the claims, ultimately concluding that there was no confirmation of any financial obligation.
The judge deemed the plaintiff’s calculations legally untenable and noted that there were ongoing disputes about the interpretation of the contract. As a result, the court dismissed the lawsuit, granting Gamtel costs amounting to D50,000.00, and referred the case to arbitration.
