The High Court, under the leadership of Justice Ebrima Jaiteh, is set to hear the case involving GACH Global Trading Company Limited this Thursday. The company is seeking D58,961,150 from Kaddijatou Kebbeh and Saikou Drammeh. This case arose after the parties were unable to reach an out-of-court settlement.
GACH is attempting to recover D58,961,150 and $221,000 (or its equivalent in dalasi), which they allege were fraudulently obtained and retained by the defendants. According to GACH, these funds were intended for Gam Petroleum but were allegedly misappropriated by Madam Kebbeh and Mr. Drammeh. Furthermore, GACH seeks to recover $1,600 from Kaddijatou Kebbeh, representing the commission she earned to facilitate a petroleum product agreement.
In addition, GACH’s legal team has filed a motion requesting the court to subpoena Gam Petroleum, Vista, and Koringo to produce specific documents. Lamin Touray, the operations manager at the Gam Petroleum Storage Facility, presented the agreement between GACH and Gam Petroleum, dated July 2, 2021. GACH’s counsel, M. Tambadou, submitted this document as evidence, which Justice Jaiteh accepted.
The Manager of Gam Petroleum Depot submitted a letter from GACH’s CEO, Abubakary Jawara, addressed to former Gam Petroleum Manager Saikou Jammeh. This letter was entered into evidence by GACH’s legal representatives, and Justice Jaiteh accepted it despite an objection from Madam Kebbeh’s attorney. Additionally, the court received a letter from Gam Petroleum to Abubakary Jawara, dated November 16, 2021, which was accepted as Exhibit P5. A further letter from Jah Oil Company Limited, dated November 17, 2021, addressed to the Board Chairman of Gam Petroleum, was also submitted.
Fatoumatta Zahra, the head of operations at Koringo Company, presented an invoice dated October 18, 2021, from Koringo to Abubakary Jawara, submitted without objection from the defense counsel. Moreover, Ebrima Jabang, a witness from Vista Bank, provided a certified copy of a Swift transfer from FIB Bank dated October 20, 2021; this was likewise accepted as evidence by the court.
The proceedings have been adjourned until Monday, November 18, 2024.
