The Plaintiff Alleges a Breach of Contract Regarding Land

A land dispute involving farmer Sainey Touray, and businessman Bakary Jaiteh was brought before the Bundung Magistrate Court on Monday. Magistrate Dawda Fatty presided over the case, which revolved around a breach of contract relating to a plot of land situated in Sinchu Sorri, The Gambia.

The plaintiff claimed that on February 28, 2017, he entered a contract to purchase a plot measuring 17.00m x 25.00m in Sinchu Sorri for D380,000. Sainey Touray seeks to recover the D380,000 he paid to the defendant for the plot and D75,000 in damages due to the breach of contract. Although the defendant initially sold the plot and allocated it to the plaintiff, a dispute arose when another individual asserted ownership of the same land while the plaintiff was installing a gate.

Following this incident, the plaintiff promptly contacted the defendant, who assured him that he would allocate a different plot of land. However, despite numerous requests, the defendant failed to fulfill his promise, thereby forcing the plaintiff to pursue legal action—a disappointing turn of events.

The case has been adjourned until December 23 for further hearings.
